Yvonne Lowe:

We are in receipt of your 3 Day Notice to Vacate dated December 31, 2020. The original lease I signed on January 2015, includes an addendum for an additional occupant. Consequently, I was issued 2 sets of keys: 2 door keys, and 2 mailbox keys. My current roommate, Richard Issac Powell, has lived here since October 1, 2015, and we brought this to the attention of the person who was the manager at that time and requested they update their records, accordingly. There was never an objection to Mr. Powell becoming my third consecutive roommate, and one additional occupant. As a result, Mr. Powell has been in possession of the second set of keys issued by the original leasing manager for more than five years. 

You have been aware of Mr. Powell’s presence as an occupant to unit 212 for a significant amount of time. You noticed his presence in the unit as we prepared for the exterminator on November 11, 2020. You saw him again him again on December 2, 2020, as he returned from the Laundromat with his clothes. 

Notice how I’m using the pronouns he/him and Mr. when identifying Mr. Powell. I’m doing this to maintain consistency to avoid confusion so we will know exactly who I’m referring to. As you noticed Mr. Powell no longer uses those pronouns since he is in the process of transitioning to a transgender woman. I wanted to take a moment to formally bring this matter to your attention, because when Mr. Powell returned from the Laundromat on December 2, 2020, in a red mini skirt and matching red cropped tank top, just before you entered our unit with the exterminator, you were visibly upset by his presence. When you left our unit you reminded me of the importance to wash my clothes. I pointed out to you the obvious work in progress. Mr. Powell thanked you for your concern as you walked away, and you paused as you were walking by the staircase; you looked over your right shoulder, and gave Mr. Powell a very angry look, and did not say anything before you continued walking away.

I wanted to take a moment to bring these facts and these truths to your attention. I’m concerned your actions are retaliatory. I’m concerned the owners of St. Moritz, Winstar Management, and you may be violating Federal Fair Housing regulations, and/or state and local civil rights codes.

As a result of these concerns, I’m formally inquiring with you why, after all this time has passed, without incident, you are taking such a strong, ill advised position against Mr. Powell, insisting he is an illegal occupant.
